Man's best friend is taken

BLACKTOWN dog owner Jock Coulter had his best friend taken away four weeks ago and has not even been told if his mate is still alive.

His dog, Royce, is a 13-year-old cross staffordshire terrier and bull mastiff.

Mr Coulter fought back tears as he described how pound officers, accompanied by police, came to his door and demanded his dog.

``They said he's a dangerous breed; they say he's a pit bull,'' he said.

``I said: `No he's not; I can prove that'.''

He said Royce has never harmed any person or any other animal.

``He's so timid, he's scared of his own shadow,'' Mr Coulter said.

He said he did not know if Blacktown pound was acting on any complaints, nor could he see that any complaint was justified.

He said council officers previously told him he would have to desex Royce and build a special backyard cage for him.

Mr Coulter had his dog desexed, despite his age, but said it was cruel and unnecessary to build a cage.

Blacktown councillor Russ Dickens, who is also a veterinarian, said taking Mr Coulter's dog from him was an outrage.

``It's reprehensible and draconian that this still happens in Blacktown,'' Cr Dickens said.

He said he has treated Mr Coulter's dog over the years and was unaware of any complaints about him.

``I'll be following this up,'' he said.

A Blacktown Council spokesman said Royce was alive and in an animal holding facility.

``The dog was seized because it was deemed a restricted breed and the owner had failed to comply with the legislated requirements for housing the dog,'' he said.

``The owner had continually failed to meet the legal requirements with regard to housing the dog despite numerous requests by the council.''

Mr Coulter said: ``If Royce had done something wrong I'd understand.

``I wouldn't keep a dog that bit people.''

I read with disgust your story about Blacktown council seizing Mr. Coulter’s dog a staffy x bull mastiff and claiming the dog was a pitbull. How did Blacktown council determine the dog was a pitbull, did they conduct a DNA test or did some moron from council just say it was one. Just because it looks like one doesn’t mean it is one. Blacktown council have acted like Nazi storm troopers in this case, and I doubt they know one end of a dog from the other. When you see the conditions at the pound and how staff treat the dogs and now this, Blacktown council should hang their heads in shame. This is a perfect example of how wrong Breed Specific Legislation is, even if the dog was a restricted breed (which we don’t really know) this poor dog has done nothing wrong yet it’s been seized what a disgrace.

I hope that this man will be given time to rectify whatever legislation he hasn't complied with, so that he can get his dog back.

This is utterly disgusting and both the council and the police should be ashamed. The dog is 13 - and NOW you take it away? The idiots are in charge and everyone should be afraid.

This is a disguting act, the breed is not recognised by any canine org. The breed does not exist, how can they legislate a law when the breed is not regconised? Misfeasance An Improper Performance of a Law Act. They can be sued by Civil action. They go on beliefs, assumptions, visual identification. Its only hearsay. There is no proof. They cannot identify a pit bull its impossible its a generic term for a mixture of breeds. The legisation is flawed in all parts of Australia. De frey v Logan City Council read the magistrates comments on breed identification, there on the net and are public knowledge.You will see there is no one qualified in Australia Shame on Blacktown.

What an appalling and disgraceful act and law we have in this country. Who exactly is this Breed Specific Legislation protecting? Irresponsible dog owners still exists, dog attacks still occur and incidents of dog bites have continued to increase since the introduction of BSL. This is not just a 'pit bull' problem it is a serious problem for ALL dog owners. The only people this law hurts are responsible owners with responsible dogs. whoever heard of a 13 year old dog being seized, not because of its actions but because of what it looked like. Is this what our country has become? First we engaged in racial profiling of people - are we now subjecting our dogs to such discrimination?

So what are we going to do about this sit on our computers and complain about it being unfair and cruel not only to the poor owner but how scared must the poor dog have been. Go down and demand the dog be released, is the dog still in custody and if so why is he being held. If it was my dog I would be camping on their door step ringing every media/reporter I could find and saying I want my bloody dog back.

Perhaps Mr Calders dog would not have been seized had he followed the process and had the dog breed assessed. Council's spokesperson stated above Mr Calder CONTINUALLY FAILED to meet legislative requirements- this to me suggests he was given more than one opportunity!! There are so many nice "pitbull types" out there that have had to go thru the same process- it is an option of the owner to have the dog assessed if not under the legislation it will be deemed restricted. Dog owners need to work with council officers, im sure the last thing they want is to take someone's dog, let alone a 13yr old dog who is obviously well loved. The legislation is in place for a reason, whether we agree with it or not people, deal with it!

Misfeasance MB look it up its obvisously you didn't read my post. There is absolutely NO methodology in existence anywhere in the world by which the breed components of a dog of unknown parentage can be identified with any level of certainty. This elderly gent is suffering mentally depressed, confused, in shock. Tell me are the gov going to pay for his medical bills??? What happens if this elderly gent passes away because of the trauma?? This dog is his theraputic therapy, the dog is 13 years old how long do you think he has to live??? BSL will be inflammatory, and is based upon unproven beliefs, not facts.BSL under inclusive in that it only recognizes a threat to society from certain breeds, or mixed breed dogs.People dont get over it stand up and fight for your rights and what belong to you. Question, is the wording of the restricted dog laws unconstitutionally vague and therefore be void due to vagueness? The Legislation is Flawed. Shame on Blacktown!!!

MB Rankin's words are the true spoken words of a 'dictatorship' Perhaps this actually is what our country has become. "the legislation is in place for a reason" - what is the reason for BSL legislation in our society? Incidents of dog attacks and bites have continued to rise since its introduction. Why are some owners not complying with the legislation - fear of their dog being taken and destroyed. Anyone reading "Tango's story" can see that. (Tango's story can be found at: http://www.theaustralian.com.au/n ews/features/the-pit-bull-is-the- usual-suspect/story-e6frg8h6-1225 804507090) I myself know the fear of mis-identifiaction owning two american staffies. one a 5 year old female i recently acquired who is an ex show dog. whilst walking her in a council park (on lead) i was questioned what breed she was with the ranger suspecting a 'pit-bull'. Thankfully i have papers for her and have them with me at all times, but this is a luxury not all owners have to prove their dog is not a 'pitbull'. As for MB Rankin's comment of "Whether we agree with it or not, deal with it!" what a sad state of affairs our country would be in if we all held this view - the true words of a dictator.
