Bail will be refused in all but extraordinary circumstances for anyone charged in NSW with an offence carrying a jail term who also has terrorism links, under the latest changes announced by Premier Mike Baird following the Martin Place siege.
The measures will apply to anyone under a terrorism control order; who has previously been convicted or is on bail for a Commonwealth terrorism offence; or is on bail for or has been previously convicted of being a member of a terrorist organisation.
As well, links to a terrorist organisation, actions and comments advocating support for terrorism or "violent extremism" or association with people or groups that advocate it will be considered when deciding if a person is an "unacceptable risk" for bail.
"It's really quite simple: if you have any links to terrorism in this state or country or anywhere you will not receive bail in NSW," Mr Baird said.
Making the announcement, Mr Baird reflected on the families of those who were killed in the siege, during which gunman Man Haron Monis held hostages at gunpoint at the Lindt Cafe in Martin Place in December.
Two hostages, cafe manager Tori Johnson and barrister Katrina Dawson, were killed.
Monis was on bail despite being charged with a string of sexual assault offences and a charge of being an accessory to the murder of his former wife.
A coronial inquest has been examining why this was the case.
"Nothing can change that day," Mr Baird said. "But what we can do is learn from it."
Mr Baird said he was advised that changes to bail laws already undertaken would have seen Monis refused bail, but the proposed new rules were "additional protection measures".
"Whilst it may be intuitive in terms of the terrorist links ... we want to take away every possible capacity that anyone can be on the street in terms of bail if they [have] any links to terrorism," he said.
Also on Friday, Deputy Premier and Police Minister Troy Grant announced that a new offence of possession of an illegal firearm would be created with a maximum penalty of 14 years.
Penalties of "at least 14 years imprisonment" would be introduced for unauthorised possession, acquisition or use of a pistol, prohibited firearm or a firearm that is "defaced, unregistered or stolen", he said.
An Illegal Firearms Investigation and Reward Scheme would also be created offering up to $10,000 for information leading to conviction of a person for possessing an illegal firearm.
Opposition Leader Luke Foley described the bail provisions as "common sense" and said Labor would support them and the firearms penalties.
