Joseph Stephen Rosenburg saw a sick teenager lying on a Sydney street, followed her into Hyde Park, and repeatedly raped her.
But Rosenburg - described by a judge as "predatory" - claims he was lured by the young woman, and was the victim of an elaborate scam to get his DNA.
Rosenburg, who was jailed for a maximum of 11 years for the rapes, took his case to the NSW Court of Criminal Appeal, claiming there had been a miscarriage of justice.
Justice Monika Schmidt described his appeal as "incoherent, contradictory and irrational".
Rosenburg, who represented himself before the three-judge panel, claimed the woman wanted to cover up leaving a nightclub with a friend's boyfriend that night in August 2013.
"To escape any ridicule from that, she's basically got my DNA, consensually, and then seen a window of opportunity to cry rape," Rosenburg told the appeal court.
The court found there was no evidence to support his theory, the prosecution case against him was strong, and it was open for the District Court jury to have found him guilty.
Rosenburg also tried to argue that he was not properly represented at trial because his barrister did not put the "scam" scenario before the jury.
The appeals court found the barrister had "very competently" represented his client.
Rosenburg's appeal was dismissed last month.
Judge Stephen Hanley sentenced Rosenburg to a non-parole period of eight years and three months, after the jury found him guilty in 2015.
The jury heard the victim had been drinking with friends at a nightclub on Oxford Street, Darlinghurst.
She left in a taxi, but got out when she felt sick, and lay down on the ledge of a building across from Hyde Park.
Rosenburg approached her and put his hand up her skirt, and then followed her into the park, where he raped her three times, while she was lying sick under a tree.
The woman sent text messages to friends during the attack, pleading for help.
A friend drove into the city to pick her up, and found her "lying in a ball, all crouched up", covered in scratches, with sticks and leaves through her hair.
Judge Hanley said Rosenburg "was motivated by his own sexual gratification and had no regard to the discomfort and humiliation he was causing to the victim".
"He took advantage of the fact that she was vulnerable as a result of her obvious state of intoxication and … his behaviour was predatory."
